FIFTH SECTION

DECISION

Application no. 35739/17
Carolina DUTCA
against the Republic of Moldova and Russia

The European Court of Human Rights (Fifth Section), sitting on 20 November 2025 as a Committee composed of:

Andreas Zünd, President,
Diana Sârcu,
Mykola Gnatovskyy, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 30 April 2017,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms Carolina Dutca, was born in 1995. She was represented by Mr A. Postică, a lawyer practising in Chișinău.

The case concerns the alleged violations of Articles 10 and 13 of the Convention, in the selfproclaimed “Moldovan Republic of Transnistria” (the “MRT”) on the territory of the Republic of Moldova.

The applicant’s complaints were communicated to the Governments of Moldova and Russia (“the Governments”).

On 30 May 2025 the applicant’s lawyer informed the Registry that she wanted to withdraw the application to the Court.

THE LAW

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

The Court, however, reiterates that under Article 37 § 2 of the Convention it may decide to restore the application to its list of cases if it considers that the circumstances justify such a course.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 11 December 2025.

Viktoriya Maradudina Andreas Zünd
