Having regard to the above application lodged on 7 July 2022,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Marian-Alexandru Bucureşteanu, was born in 1997.

The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”).

On 20 September 2024 the Government informed the Registry that the applicant had died on 21 May 2024.

On 22 October 2024 the Registry sent a letter, by registered post, to the applicant’s home address, asking whether there was any potential heir wishing to pursue the proceedings before the Court, with a deadline for reply set for 3 December 2024. No reply has been received by the Registry.

On 28 January 2025 a letter, notifying that the time allowed for the submission of the requested information had expired, was again sent by registered post to the applicant’s home address. It also mentioned Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that a party does not intend to pursue the application. The letter was returned to the Court.

THE LAW

In the light of the foregoing, the Court concludes that the applicant’s heirs do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
