Having regard to the above application lodged on 23 December 2016,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Ioan-Sorin Găluț, was born in 1970.

The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”).

On 30 May 2022 the applicant’s son informed the Court that the applicant had died and that he intends to pursue his father’s application.

On 29 September 2022 the Registry sent a letter to the applicant’s son, asking for a copy of an authentic document issued by the domestic authorities certifying that the person wishing to pursue the application is the applicant’s legal heir (“certificat de moștenitor”).

On 9 October 2022 a strike-out warning letter was sent by registered post, to the applicant’s son, with a deadline for reply set for 9 December 2022. The notice of receipt of the letter was signed by the applicant’s son on 8 November 2022. To this date, he neither submitted a copy of a document proving his capacity as a heir of the deceased applicant, nor he has provided an explanation for the failure to comply with the Registry’s instructions.

THE LAW

In the light of the foregoing, the Court concludes that the applicant’s heir does not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
