THIRD SECTION

DECISION

Application no. 51688/21
S.A.
against Greece

The European Court of Human Rights (Third Section), sitting on 19 January 2023 as a Committee composed of:

Darian Pavli, President,
Ioannis Ktistakis,
Andreas Zünd, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 21 October 2021,

Having regard to the decision to grant the applicant anonymity under Rule 47 § 4 of the Rules of Court,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms S.A., was born in 2016.

The applicant was represented by Ms A. Ntailiani, a lawyer practising in Athens.

The applicant’s complaint under Article 3 of the Convention concerning the applicant’s living conditions and medical treatment was communicated to the Greek Government (“the Government”).

On 11 November 2022 the applicant’s representative, while contesting the version of facts as submitted by the Respondent State on 29 August 2022, informed the Registry that the applicant wanted to withdraw the application to the Court.

THE LAW

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 9 February 2023.

Viktoriya Maradudina Darian Pavli
Acting Deputy Registrar President
