FIRST SECTION

DECISION

Application no. 15075/22
Sándor ALANYAI
against Hungary

The European Court of Human Rights (First Section), sitting on 8 December 2022 as a Committee composed of:

Krzysztof Wojtyczek, President,
Ivana Jelić,
Erik Wennerström, judges,

and Attila Teplán, Acting Deputy Section Registrar,

Having regard to the above application lodged on 9 March 2022,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Sándor Alanyai, was born in 1993.

The applicant’s complaints under Article 5 §§ 3 and 4 of the Convention concerning his detention on remand were communicated to the Hungarian Government (“the Government”).

On 4 November 2022 the Government informed the Registry that the applicant had died on 26 June 2022. On 11 November 2022 the applicant’s lawyer submitted that no successors could be identified and that the application to the Court would not be pursued.

THE LAW

In the light of the foregoing, the Court concludes that the applicant’s heirs, if any, do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 12 January 2023.
