Having regard to the above application lodged on 16 May 2013,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Władysław Kłaput, was born in 1944. He was represented by Mr M. Klatkiewicz, a lawyer practising in Kraków.
The applicant’s complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 about revocation of his right to a structural pension were communicated to the Polish Government (“the Government”).
On 12 August 2022 the applicant’s representative informed the Registry that the applicant had died. He did not indicate that the applicant had any heirs whose intention would be to pursue the application to the Court. He also failed to reply to the Registry’s letter asking for a further clarification on that matter.
THE LAW
In the light of the foregoing, the Court concludes that the applicant’s heirs, if any, do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.
Furthermore, the Court considers that respect for human rights as defined in the Convention and its Protocols does not require the continued examination of the case.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
