Having regard to the above application lodged on 15 June 2018,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Dzhamalay Musayevich Tazbiyev, was born in 1998. He was represented by Ms K.S. Akhmadova, a lawyer practising in Zheleznovodsk.
The applicant’s complaints under Articles 3, 5 § 1, 6 § 1 and 6 § 3 (c) of the Convention concerning his ill-treatment by the police, unrecorded detention, unfairness of criminal proceedings as based on his confession statements obtained under duress and the absence of access to a lawyer during the unrecorded detention were communicated to the Russian Government (“the Government”).
On 31 January 2022 the applicant informed the Registry that he wanted to withdraw his application from the Court.
On 10 March 2022 the applicant’s representative confirmed that the applicant is no longer in detention and his will was expressed without pressure.
THE LAW
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require its continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
