Having regard to the above application lodged on 23 March 2009,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Maksim Yuryevich Maksimov, was born in 1980.

The Court communicated to the Russian Government (“the Government”) the issue concerning the delayed enforcement of the final judgment in the applicant’s favour and declared the remainder of the application inadmissible.

Following the communication of the case to the Government, the applicant in his letter on 18 June 2010 expressly indicted that he had never complained to the Court about the non-enforcement of the final judgment in his favour and that his main grievances, which had been declared by the Court inadmissible at the communication stage, had nothing to do with the complaints which were communicated to the Government.

THE LAW

In the light of the applicant’s statements following the communication of the case, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
