FIFTH SECTION

DECISION

Application no. 13468/17
Mariya Onufriyivna KOVALCHUK against Ukraine
and 5 other applications

(see appended table)

The European Court of Human Rights (Fifth Section), sitting on 18 September 2025 as a Committee composed of:

Andreas Zünd, President,
Diana Sârcu,
Mykola Gnatovskyy, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above applications lodged on the various dates indicated in the appended table,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms Mariya Onufriyivna Kovalchuk, was born in 1940. The list of her applications is set out in the appendix.

The applicant was represented by Ms A. Arustamyan, a lawyer practising in Vinnytsya.

The applicant’s complaints under Article 6 § 1 of the Convention concerning limitations on access to a court were communicated to the Ukrainian Government (“the Government”), who submitted observations on 7 November 2024 on the admissibility and merits. The observations were forwarded to the applicant’s representative, who was invited to submit her own observations. They were downloaded from the Court’s Electronic Communication Service platform (eComms) on 20 November 2024. No reply was received to the Court’s letter.

By letter dated 21 February 2025, sent via eComms, the applicant’s representative was notified that the period allowed for submission of her observations had expired and that no extension of time had been requested. Ms Arustamyan was also notified that it had been decided to grant the applicant a new timelimit to submit her observations, until 4 April 2025. The applicant’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The representative downloaded this letter from the eComms platform on 6 July 2025. However, no response has followed.

THE LAW

Having regard to the similar subject matter of the applications lodged by the same applicant, the Court finds it appropriate to examine them jointly in a single decision.

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the applications.

Accordingly, the applications should be struck out of the list of cases.

For these reasons, the Court, unanimously,

Decides to join the applications;

Decides to strike the applications out of its list of cases.

Done in English and notified in writing on 9 October 2025.

Viktoriya Maradudina Andreas Zünd
Acting Deputy Registrar President
