Having regard to the above application lodged on 15 January 2021,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Sahara Bank S.A., is a company registered under Libyan law, with its seat in Tripoli.

The applicant’s complaints under Article 1 of Protocol No. 1 to the Convention concerning a restriction on its financial guarantees were communicated to the Hungarian Government (“the Government”), who submitted observations on the admissibility and merits on 27 March 2025.

By letter dated 6 December 2024, sent by registered post, the applicant was notified that the application had been communicated to the Government and was invited to provide for legal representation. No reply has been received to this letter. All subsequent attempts of the Registry (by email, fax, surface mail and telephone) to contact the applicant remained unsuccessful. Postal enquiry to track the registered letter was not possible. No communication has reached the Registry from the applicant’s side since 21 December 2023.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
