Having regard to the above application lodged on 7 September 2020,
Having regard to the decision to grant the applicant anonymity, in accordance with Rule 47 § 4 of the Rules of the Court,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, B.Y. was born in 1940. She was represented by Ms E. Kriona Saranti, a lawyer practising in Athens.
The applicant’s complaints under Articles 3 and 13 of the Convention concerning the conditions of her detention and the existence of an effective remedy in respect of her complaint that her removal to Türkiye would expose her to a real risk of being subjected to treatment contrary to Article 3 of the Convention, as well as under Article 5 § 2 of the Convention concerning her right to be informed promptly, in a language she understands, of the reasons for her detention, were communicated to the Greek Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit her own observations.
By her observations submitted in respect of applications nos. 39926/20 and 40725/20 dated 16 October 2024, the applicant’s representative informed the Court that she had lost contact with the applicant and would not submit observations in relation to her.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
