FIRST SECTION

DECISION

Application no. 34685/23
X and Others
against Sweden

The European Court of Human Rights (First Section), sitting on 4 December 2025 as a Committee composed of:

Frédéric Krenc, President,
Davor Derenčinović,
Alain Chablais, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 16 September 2023,

Having regard to the decision to grant the applicants anonymity under Rule 47 § 4 of the Rules of Court,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicants are three Eritrean nationals. They were represented by Mr D. Loveday, a lawyer practising in Berlin.

The applicants’ complaint under Article 8 of the Convention concerning the Swedish authorities’ refusal to grant residence permits to the second and third applicants for family reunification with the first applicant, who was residing in Sweden, was communicated to the Swedish Government (“the Government”).

On 5 November 2025 the applicants informed the Registry that they wanted to withdraw the application to the Court for personal reasons and since the second and third applicants had been granted residence permits in Sweden.

THE LAW

In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 8 January 2026.

Viktoriya Maradudina Frédéric Krenc
Acting Deputy Registrar President
