FIRST SECTION
DECISION
Application no. 36702/23
N.A
against Sweden
The European Court of Human Rights (First Section), sitting on 9 April 2026 as a Committee composed of:
Raffaele Sabato, President,
Artūrs Kučs,
Anna Adamska-Gallant, judges,
and Viktoriya Maradudina, Acting Deputy Section Registrar,
Having regard to the above application against the Kingdom of Sweden lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) on 27 September 2023,
Having regard to the decision not to have the applicant’s name disclosed,
Having deliberated, decides as follows:
- FACTS AND PROCEDURE
The applicant was born in 1984. He was represented by Mr M. Nyman, a lawyer practising in Stockholm.
The applicant’s complaints under Articles 2 and/or 3 of the Convention concerning his deportation were communicated to the Swedish Government (“the Government”).
On 20 November 2025 Swedish authorities granted the applicant refugee status and a temporary residence permit. In the same decision, the deportation order that had until then been in force was revoked.
On 18 February 2026 the applicant informed the Registry that he wanted to withdraw the application to the Court.
- THE LAW
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 13 May 2026.
Viktoriya Maradudina Raffaele Sabato
