THIRD SECTION

DECISION

Applications nos. 45354/16 and 56514/21
Arben BIÇAKU against Albania
and Klodian RJEPAJ against Albania
(see appended table)

The European Court of Human Rights (Third Section), sitting on 18 December 2025 as a Committee composed of:

Diana Kovatcheva, President,
Canòlic Mingorance Cairat,
Vasilka Sancin, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above applications lodged on 25 July 2016 and 16 November 2021,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix.

The applicants’ complaints under Articles 6 and 8 of the Convention and Article 1 of Protocol No. 1 to the Convention, were communicated to the Albanian Government, who submitted observations on the admissibility and merits.

The observations were forwarded to the applicants, who were invited to submit their observations in reply. The applicants did not submit any reply.

By letters sent by registered post and through the Court’s Electronic Communication Service (eComms), the applicants and their representatives were notified that the period allowed for submission of their observations had expired and that no extension of time had been requested. Their attention was further drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application.

However, no response has followed.

THE LAW

The Court finds it appropriate to examine the applications jointly in a single decision.

In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue the applications (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto, which would require the continued examination of the applications.

Accordingly, the cases should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to join the applications;

Decides to strike the applications out of its list of cases.

Done in English and notified in writing on 22 January 2026.

Viktoriya Maradudina Diana Kovatcheva
Acting Deputy Registrar President
